R.M. COURT, ALEXANDRA.

Tuesday, March 29. Before Jackson Keddell, Esq., R.M. Jas. Paget v. N. A. Anderson ; summons for assault and battery. Claim, £SO for damages, MrS Turton, solicitor, for plaintiff; Mr F. J. Wilson for defendant. Mr Wilson contended that the Court had no jurisdiction to hear the class of action. Plaintiff being a minor, and suing by his fa'her as his next friend, tho only Court he could resort to was the Supremo Court, as there was no provision in “ The Resident Magistrates’ Act ’’ for such an action as this. Mr Turton quoted from Addison on Torts, showing that action by minor would lie. Mr Wilson admitted that action would lie, but not in this Court. The Bench said the point was one never before raised in the Court, and he would have to take time to consider it. Mr Turton- Your Worship may make a note of the point and go on with the evidence. Mr Wilson, with deference to the Court, must object to go on with the case till the question of jurisdiction was settled. The case was adjourned till Wednesday, April 13. L. Cameron v. N. A. Anderson.—This was an action similar to the above, and the same ruling was ma le. CIVIL case. Rivers v. Becker; claim, £l2 7s, for goods supplied. No appearance of defendant. Judgment for amount claimed and costs. 235. WARDEN’S COURT. Tuesday, March 29, ISBI N. A. Anderson. Application to alter course of water-race at Batcher's Point.— Granted. The same. Application for extended claim at Doctor’s Point, —Granted. W. Hansen and G. Cameron. Application for extension of head water-race.— Granted. Toe same. Application for extended •claim.—Granted. The same. Tail-race.—Granted.
