RESIDENT MAGISTRATE’S COURT, CLYDE.
(Before Jackson Keddell, Esq., R.M.) Friday, December 17th, ISBO. James Hogan was charged on the information of Constable, M'Leod with burglariously breaking into the Geelong hotel, between 1 and 2 a.m. on the morning of the loth instant and stealing a rifle, a silver "watch and a quantity of wearing apparel, of the value of Ll4 The accused was further charged with being illegally on the premises, The first charge was withdrawn by the police. On the secon I charge the following evidence was take i. Biidget Robertson sworn—Am the wife of William Robertson, proprietor and landlord of the Geelong .hotel, Alexandra. ■ On On the night of the loth I was at homo, and retired to bed about 11 pm-. Between 1 and 2 the following morning I was awoke by a slight noise in the room. After listening for a while I saw a shadow in the doorway of the room—it went down as if to its knees. I then a \\V it was a man with a slouched hat on. There was no light in the room excepting front the moon, rftid that was very indistinct. I kept looking at the object ; it crawled to the side of the be l, neatly touching my band which was on the Outside of the clothes. I was afraid to speak fearing he might strangle mn. t kicked my,husband till I awoke him, ami said there is a man in the house My husband sal up in the bed and said. What! The man then got on to his feet, and ran out of the room, miking but little noise as if he had no boo's on, my. husband following him. 1 then got up and called a lodger, telling him to go for the police as there had been a robber in the house. I went to the back door and saw in the yard a lot of clothing. I was the last up in the house; aU doors were fastened, except the back door. 1 left in the bar till 2s 61, .also a number of papers. 1 was awoke by my wife kicking me. I got up and ran round the house and looked up and down the street, but could see no one. I returned to the house to put on some clothing, against the side of. the house I f mud a rifl; pro Inood, on entering the yard 1 saw William Jar line, a lodger, in the house, who took the rifle from me and said he would go for the police. After putting on some clothes I again went outside when I lunard William Jardine calling out Bill. 1 went to him and saw him in company with accused, who I at once seized, as he had no boots. Constable M'Leod then came up and I gave accused into custody. We all returned to the hj .tel; ami on making an examination 1 found the contents of the till laying on the top of the counter. By the side of the papers were the remains of six burned wax mitches, the two shillings and sixpence were missing, niy watch was taken out of my waistcoat, a rifle, and a lot of wearing apparel were missing, the latter, also the rifle and watch wore found outside the house. The accused was not a lo Iger, nor had ho engaged a bod, nor had he any right to be on the premises. William Jardine and Constable M Leol deposed, as to the arrest of .accused, also that accused admitted the hoots found were his, saying as ho was going to get into a scrape, he might as well own them The Magistrate after summing up the evidence sentenced the prisoned to 12 months’ hard labor in Dunedin Gaol. (Before Vincent Fyke Esq., J.P.,) Wednesday, December. 22nd. Archibald M'Leod, a . shepher I, in the employ of Messrs M‘Larch and Turnbu l, of Mnutere station, was brought up on warrant, and charge 1 with maiming and wounding a cow, belonging to James M ‘Arthur, of Wai Keri Keri Valley, farmer. The accused was remanded oil bail to the 24th inst., when the case will be heard before the Resident Magistrate. . '
