WASTE LANDS BOARD.
The following business was transacted at the sitting erf the Waste Lands Board held on the 23rd instant
Tbe Secretary of the Education Board applied for ten acres in block VI, Lauder district, how fcutfibered section 3, to be reserved as a school site.—lt was resolved—- “ That the Government be recommended to make the reserve, as requested. Mr Robert Kidd’s application for half de-ferred-payment section 8, block IX, Tarras district, was declined. The adjourned application of J, Aolt for a coal-mining lease of 20 acres in the Leaning Rock district was brought up for reconsideration, on the motion of Mr Stout, in-
structed by U. T. Marie, who applied for a lease of eight acres of the land particularised in Holt’s application. Mr Donnistou appeared for Holt, and Mr Maogregor for Marie. The Chairman said the applications came before the Board for the first time on the 12th of May, 1830, when it was resolved to refuse Marie’s application and publish the Board’s intention to grant Holt’s application in the Gazette of 20th of may. On the 9th instant the Board agreed to hear the motion for reconsideration ot the case on the 23rd. A letter was received from Mr Marie, stating that he had pegged off the land in'questien before Holt, and a witness was in attendance to prove the fact. Mr Dennlstoh Urged tint the report of the Warden containing the sworn testimony of Marie, Holt, and other witnesses should be held conclusive, and in his evidence Marie had deposed that he could not positively say when he pegged off the ground.—The Chief Commissioner thought the Board would agree with him in declaring that any statements now made before the Board in the shape of a letter from one of the parties concerned would not weigh with tlie Board as against the sworn testimony of the same person in a vita roce examination and cross-examination before the Warden. He the (Commissioner) thought the Board could only come to the same conclusion as before. Of course it was quite open to the parties to have come before the Board with the view of modifying the application.—lt was resolved That the mineral lease be granted to J. Holt as originally applied for. 1 ’
