The Dunstan Times.

FRIDAY, DECEMBER 20, 1878.

Denea'h the rule of men entirely just the PEN is MIGHTIER than the sword.

Mr Simpson, R.M., at Alexandra, on Monday last, held an enquiry into the m itters alleged in a Petition prayin' that tha late election of Mavor of that Borough (Mr Wm. Henry Hastedt being elected) lie declared void. Mr G. N. McDonald app on behalf of the petitioners; Mr Haste It was also in attendance. Mr Me Don 11 said there were two allegations in the petition ; he would rest on the one, viz , “That sufficient notice had not been given of the election, eleven dayson'y having been given instead of fourteen.” He said the election altogether was illegal, and it was desire! to upset it. Mr Hastedt said the election took place on the day appointed by the “ MunicipalCorpn a'ions Act, 1870,’’ and he fared to see that it could be upset. Heobjec'ed to the whole proceeding, because, had anyone else have been elected no notice would have been taken but as he was elected the attempt was made to oust him Mr Simpson said he would reserve judgment for a few days.— tg over this question another one arises, whether the office of Mayor is vacant. Pending a decision we print Section 3 and 4 >f the “Municipal C»rporations Act Amendment Act, 18777’ and from which it will be seen that the office i< no; vacant till the election of a successor. Section 3 says,—Every Council shall continue in i ffice until th-ir successors are elected, and take > ffioe ; and the expression ‘ Council ’ shall include Municipal Councils cons iluted under the “Otago Municipal Corporations Ordinance, ISG.j,” wh'ch may have become a borough under this Act. - Tula provision shall lie deemed to have come into operation on the same day as the “Municipal Corporations Act, 1870” canv into operation, and any Council which shall have gone out of office at any tin e pie' i»us to the passing of this Act, and to whom no successors have been elected shall I'Cde meil to have continued in i ffiee, and may exercise all the powers, duties, and functions of such Council until their su'-cessors shall take office in the. same manner as if it had not gone out of office. Section 4.—Every Councillor shall come into office on the day of his election, and shall cease to hold office on the day his successor comes into office.

Henry Lion Metz, who has been arrested at Adelaide for forgery, is now on his way back to Dunedin in charge of Detective Bain. The wrestling match between Tyson and Thomas resulted in a defeat tor the latter. From all accounts we learn that it was a matter of brute strength purely, there being no skill whatever exhibited. Mr Mollison, who has been engaged surveying the Scrath-Taeiri line of railway thr ugh the Lauder Gorge, and from thence on to Cliatto Creek, has returned to Dunedin, Mr Hay from the Public Works Department succeeding him. By the Cromwell Argus we perceive that a fire took place on Sunday night last in Murray street, On mwell, resulting in the total loss of the dwelling-house and conten's, the property of Mr M. Shafcoe. The property, we are sorry to say, was uninsured. , Some 1.48 in cash was in the house at the time, which was 1- st also. Mr R. H. Leary. (Retiling) Mayor of Dunedin, was presented on Monday last in the City Council Chambers with aciadle, inkstand, and inks'and.llhc whole of silver, to commemoiate the fact that that gentleman his had a child presented to him doling his term of office. Mr Walter, Mayor elect, made the presentation. Mr Leary, in rep'ying said, with regard to the family event which was commemorated, he was incline 1 to retard tin birth of another son as a calamity, but looking at the valuable gifts he did not. W are reqoestelto draw piiticu'ar attention to the programme of snorts - to be held at Clyde on New Year’s Day. On reference to the programme, which is to be sc n in another column, it will be seen that it contains a variety of events, in which old and y nmg can participate, and that whilst the p-izss are mo it liberal the entrance fees are particularly small, within the means of everyone. The object of the Commit' ee hj is apparently been to provide a good day’s sport, and from what vve can see they have d-nethe’r part, and it but requires the public to attend an 1 complete it. The paroquet pest appears to have bei n in former years equally as great in Oaniaru as it was in this district. Tins year, with th j exception of one or two stragg ers, they have disappeared from both localities. A Corn spindent of one of our Oamaru contemporaries thinks they have only for a time taken to the bush to attend to family matter', and that thej will return in full force when the proper time arrives. Whilst hoping they will not, we at the same time do nut think they will return, at all events for a few years. O ago, since its earliest days of settlement, has been occasionally visited, and no one could tell from where by swarms of these birds, and we think the last was one of these occasional visits. We ha ! the pleasure, on Monday last at Alexandra, of viewing a magnificent speckled trout th it h.i I been c night in a dam, fed from one of the numerous water-races heading out of the BiriHc'engh river ; it wis 19 inches long, with a girth of ten inches, and weighed 31" 9 >z. Mr Noble, who caught it informed ns that the head of the dam in which it was had broken away, and when his attention was drawn - o it by some of ins children it was tioun ering in the shallow water and mud. Mr V. Fyke was the fortunate recipient of the finny stranger, anlto the inquisitive will doubtless be pleased to info ni them as to its quality. A gentleman, who ilelights in a very watery nam'. and who was present thought it was anything but a Noh'e ac ioito give so gran 1 a lia'i to a T’yke ; yes, says another, it would Lave been far nobler to have bestowed it on a 1 iver. T.ie London Examiner of the 2Sth Septe her, in an article - n “ Onr Colonial Emp’re says : “ New Zealand is the only Colony about which there is any reason to suspect th it i s growth is in any way real’y unhealthy A Government that, hiving ac cumulated a debt of L8,49G,01C by 1871, when its exported pro 1 nee was worth L 5, 17’,h44, fount itself in debt to th“ extent of 1.17,121,531 iu 1875, when the va’ue o f its exports had only risen to L-5.475,814. can be hardly looked upon as in a s dveit condition. The cheerful reckl ssness with which this Colony is spending money on railways and nther public works may possibly bring profit, to it in time; but of its present population, m uiy \vi 1 probably soon have to be content with the reflection thi f they have mine 1 themselves, or allowed their Parliamentary representatives and Ministers to ruin them, for the sake of conferring a do ihtful hen fit on their remote successors.” The Examiner takes its figures from Mr Giff-n’s Blue Book, and the ah-sn-dify of the conc’usions it draws from then c is only paralleled by the unfairness of using ih° figures of 875 when so much later ones were obtainable.—Daily Times.
