Each Tender must he accompanied with a deposit (in cash, or by a marked cheque), equal to 5 per cent, on the amount of the Tender, which deposit will be forfeited if the Tenderer fails or neglects to take up the contract within seven days from the acceptance, by the County Council, of such Tender. "IVT OTIC E is hereby given that on -LV the application of the majority of persons from whoso claims water and tailings flow to a common outlet at the mouth of the Wai Keri ‘Keri Creek on the Moiyneux river, the use of the natui al bed of the said Creek from the boundary between Mr Feraud’s freehold and the Government Paddock . to the mouth of the said Creek was on the 22nd November, 1877 granted in terras of an application, and on condition ; Ist—That Head Water Races might be constructed from theaaid main Tail Race, provided the utility of the said main Tail Race was not interfered with, nor more than one half of the water flowing in the said main Tail Race diverted. 2nd—That where necessary in the opinion of the Warden for the time, defensive works will be constructed to prevent the water carrying away the banks of the said Creek. TAKE NOTICE that it is intended to construct a Water Race and divert water lor irrigatiion purposes, commencing at a point iu the Main Tail Race, Wai Keri Keri, half a mile or thereabouts from the lower e.id of Government paddock, and terminating at one point at Clyde Pound Farm, and at another point at The Elms. The length of such Water Race is about one mile and a half with an average depth of nine inches, and a width of two feet six inches, and to carry two Sluice heads of water in accordance with Sub Section! of Section '3l of “ The Mines Act, 1877.” We have notified to all parties concerned with our intentions.
