WARDEN'S COURT.
Tiiuksiut, .March 14, 1878. 1 Marie v. Lawson and others—Damage i done to private road. In giving judgment 1 the Warden said it was open to question if f the plaintiff could not have maintained his 1 ease had it been brought differently and not £ of such an exaggerated nature, and he could i not but characterise the demand as an at- 1 tempt to extort money. The item, Ll3O , for damages to road, was ridiculous. He s had instructed the Surveyor to visit the t road, who reported that two men in four or j five days could put the road in good repair. , The contention that plaintiff had mo right ( to the road, it being made without authority, j was no good, as he would not say but that , defendants ' would become liable for any ] damage done though the road was un- , authorised. Had the action been merely , for damages ho would have given judgment. j He would nonsuit the plaintiff. The Warden then suggested that defendants should ■ so construct* their tail-race as to prevent the road being injured. It was.afterwards - arranged that the Surveyor should point ; ont what was.necessary to bo done, and ile- j fend ants-agreed to do it. ( M‘Leort v. Naylor. "Cancellation of water licenses, same not having been renewed for over two years. There being an informality in the summons, a fresh one was ordered to be issued free of charge. F. ,1. Wilson v. Naylor. Friendly suit for infliction of fine instead of cancellation of water licenses. M'Leod, the former plaintiff, objected. Adjourned lor 14 days for attendance of the rightful owner of the water races, James Norman, who, it transpired in evidence, had failed to renew tho licenses -in question. J. E. Stevens, Treasurer of tho Duustan District Hospital, applied f..r right of one head of water from the Wai Buna Creek. Adjourned till after the next sitting of tho District Court, as the right may revert to the Clyde -Corporation.
