SUB-MARINE GOLD MINING COMPANY.

In the District Court, Lawrence, before Judge Harvey—Mr Mouat, on behalf of Messrs Fish, Scanlan, and a number of shareholders, applied for an order for the examination of Mr W. O. Bali, Liquidator of the Company. Mr Scanlan attended, and stated that ho and Mr Fish and other shareholders applied for information at the Office-fend could mot-obtain satisfactory answers to their request. His Honor granted the order. Mr Ball was then sworn, and Mr Mouat proceeded to examine him, Mr Howorth appearing on his behalf. His Honor ruled that ho could not be examined as to the claims made against the Company, the proper course being to examine the claimants. As this would not result in obtaining the required information, Mr Mouat discontinued the examination and moved for a rule nisi'ealling upon the Liquidator and petitioning creditors to show cause why the liquidation should not be sot aside, on the ground that the petitioning creditor had no status, as his shares had been forfeited and his claim was more than a year old ; also on the ground that there was nothing to show that there had been a meeting of creditors, or whether any creditors bad attended and voted at the Liquidator’s appointment. His Honor granted separate rules on those grounds.
