In the Ueaiil jnt Magistrate s Court, Clyde, on Thursday the 30th ultimo, before W. L, Simpson, Esq., R.M., A. Blue was sued by the Trustees of the Clyde Building Society, as mortagoea of the Old Bendigo Family Motel, for LSO damages, for breach of Covenant of Lease—the losing of the License ot the said Elotel. For plaintiffs it was urged that the damage was sustained immediately the License Was lost, and expert evidence adduced that by the losing of the License the property had depreciated to the extent of LSO, inasmuch as if the house were put in the market as a Licensed Hotel, it would realize LSO more than if merely as a building suitable for a hotel. The other side argued that Plaintiffs sustain no damage till the expiry of the term of defendant’s Lease, and there is no evidence to shew that the mortgage may not ho realized prior to tho said term. Decision reserved. A. Blue v. Watt—Debt. Settled out of Court, Shortly after midnight on Wednesday last, a destructive fire occurred on Mr Clark’s premises, baker, Lawrence, resulting in the partial destruction of the back of the premises, also the stable and some outbuildings, and, sadder than all, in the.death of two tine lads, employed on the premises, named respectively, H iard, ago I between 14 and 15, and Hart, aged between 13 ami 14. The fire broke out in the part of tho buildings where ’the lads slept, ami it is surmised that when going to sleep they left the can ila burning, and that by some mischance it set fire to the bed clothe), ;ad from the position each was found after tl o flames subsided, each lying in his'own bed, that they were smothered with the sm ke before the flames burst out. The young r, we are informed, was dreadfully burnt, tie other, not so badly, both presenting a horrible spectacle. On the first alarm of the fire the Fire Brigade were quickly on the spot, and with the aid of the powerful water supply that Lawrence is blessed, and a lurge number of willing hands that were attracted to the spot, succeeded in extinguishing the flames before further damage was done than above stated. This well known and talented Company appeared at the Town Hall, Clyde on Friday and Saturday last to large and appreciative audiences. Min Lillie Florence presided at the pianoforte in a creditable manner.
