—o—- " - Friday*' A nous? 7. (Before Mr Warden Simpson.) Goodger and party v. Thomas and Tippett. -This was an action brought by the complainants, upon the folio winggrouuds 1. That the defendants, or their principals, Richard Thomas and Charles Tippett, are the owners of a license for a Water Race, No. 00008, dated 24th June, 18C3 ; and that they have forfeited their superior right by disuse, th 'ough water' was available from the month of November, 1870, to July 30th, 1874. 3. That on or about the 27th day of Juiie last the [complainants, (by ' their solicitor, notified to the defendants that unless they the defendants [acknowledged in writing, within two days from said date, that the complainants’ right to said race (License 1208, dated 11th May,? 18?0) was superior to said License, No. 00098, in consequence of disuse by them (the defendants) that the complainants [would take steps in this Court to have the complainants’ right declared the-prior, and'superior right. After hearing a deal of conflicting evi clenco the Warden reserved judgment -till to-day. Mr Cowan for complainants; and Mr Wilson for defendants-. An Gow and others v. Ritchie.—Claim for L3O damages, occasioned through defendant having unlawfully deprived the complainants of the use of their water for a period of 8 days. Mr Cowan for complainants. Case adjourned till next Court day, for attendance of Chinese Interpreter.
