AGRICULTURAL LIEN ACT.

Among tlie varied amendments and mutations of the New Zealand statutes, which are the inevitable result of each succeeding session of Parliament,; it has Veen deemed expedient to amend the law' known as the “The Agricultural Produce lien Act 1870”, legalising the granting of preferable lien* on yea.ly craps, without paring with the po3s„ssion thereof. The amended act which came into operation on the first uH, t and bea’B the the title on the “ Asricnltu, ral Lien Act, 1871,” repeals that, of 1870, an 1 contains the following provisions and stipulations. The levnlised documentary form of security bring set forth in the Schedule to the said act. Subject, however, to such alterations, limited to strict accordance with the general terms of the Act, as varying circumstances may at times require. To validate the se. cu, 'ity it will be also necessary to register the same within certain stipulated periods. The registration officer being the sume as provided in a ca'c of wool security under the “Wool and Oil securities Act, 1858,” namely the registrar'or deputy Registrar of the Supreme Court of the Province, within which such security may be given. Seven days being allowed for registration when any such security is made or given at any place within fifty miles of the Registrars office, and fourteen days when at any place distant more tban'fifty mil s . The registrar is required to keep a separate registry of all such securities, and is entitled°a certain fee for registration ; as also set forth under the provisians of Wool and Oil Securities Act, namely, “five shillings for filing. Every one may have access to the Registrar on payment of a fee of one shilling for search, and he also entitled to a duplicate copy of every entry of security, on payment of a similar amount, The eighth clause of the act provides that in case of the dishonor o£ negotiable instruments, drawn accepted, or indorsed by a lienee at the re qust of any holder of land. “ The security so taken shall cease to operate in favor of the donee, and the agricultural produce therein mentioned, shall revert to, and revert in the lienor as effectually as if such security bad nevor been given.”. The ninth clause stipulates that the person honaf.de taking a security und. r the provisions of the Act, shall have a preferable lien ii]ion the ..hole of the Agricultural produce therein mentioned, whether growing, cut, or stored. The came to revert to and revest in tiro lienor only upon repayment of all principal interest, and other moneys secured by such security. No such security being extinguished or prejudicially affected by any subsequent sale, mortgage, or incumbrance upon the land on which such agricultural produce shall be ; nor by the death or bankruptcy of tin; lienor. On failure to pay the amount secured, the lienee may sell the agricultural produce set forth at any security, but “no security ina le under the provisions of this act, shall prejudicially affect the rights of any landlord or mortgagee of land, whereon the agricultural produce comprised in such security may be growing,” and it is further stipulated that “no security granted under the pro. visions of this act, shall continue in force for a longer period than one year from the date thereof.” The penalty for fraud, by the lienor may in any way invalidate or impair the right of the lienee, is punishment for misdemeanor, by a line not exceeding three times the amount of loss sustained by the lienee ; or imprisonment, with or without hard labor, for any period not exceeding *wo years.
