RESIDENT MAGISTRATE’S COURT CLYDE.
Wednesday. May 9. (Before Vincent Pyke, Esq., R.M.,
Henry Rivers was charged, on information, with embezzling the sum of £ll 25., the property of his employer, Edmund MOrrisey, farmer at Black’s. Prosecutor deposed that the prisoner was in his employment. On the night of the Ist. or 2nd he told him to go to a man named Spain, take a load of oats into the Dunstan. Told him also that ho was to get acheque fromNaylor for Spain. Prisoner left the'farm the following morning and he’not VVeturrtirtg in the evening he went in search of him, and found the drAy a mile and a half the Black’s fside of Chatto Creek. Inquired at Chatto Creek for prisoner, and was informed that he had gone On before. On returning to his farm he found the horses which had [come home themselves. The next time he saw prisoner was when he was in custody. C. F. Johnson, storeman to Mr. Naylor, stated that on the 3rd of May he took delivery of a quantity of oats from prisoner, and paid him for them by a cheque signed by Mr. Naylor, for £ll 2s. Produced the receipt prisoner gave. On paying prisoner he (witness) asked who the oats [belonged to and prisoner said Spain. Identified the cheque produced. A Christopher's, agent of the Bank of New South Wales, stated that he recollected prisonerTcorning into the Bank on the 3rd first and cashing the cheque produced, for £ll 2s. The prisoner 'was then demanded till Monday the 22nd first.
