Oliver and Knowles v. Slaven and others, This was an application to dissolve a mining partnership, and order an account to be taken of the profits of a race. Mr. Wilson for plaintiffs, anil Mr. Brough for defendants. This case had been adjourned the previous week to allow the plaint to be amended, and was to have been referred to arbitration, but the parties could not agree as to the matters which were to be deci led by the arbitra f ors. After hearing the evidence which showed that plaintiffs had purchased a share in No. 1, Earnscleugh Race, the remainder of which was owned by defendants who were using the water some three years ago, but had not until within the last twelve months, endeavored toicome to an arrangement with defendants as to the terms upon which they (defendants) were to have the use of their share of the water. The Warden decided that there was no partnership, but tftat the parties were joint owners, and judgment ’fqr shillings—each party to'*'pa'y->its'Vvn expenses. »
Ryan v. Devereux. This was’an action ifor obtaining a water certificate by misrepresenta ion. Defendant did rot appear. Mr. Brough appeared for plaintiffs, and s atel that defendant had evidently acted under a misapprehension, imagining the water to be running to waste. He had not however posted the necessary, notices, or his application would have been objected to. Judgment for plaintiff's, with costs of Court.
