Tuesiiay, An;ir. 4. [Before Mr. Mar den Pyke.) Messrs. MTaren, Or nig, and Co. applied for an agricultural lease of their preemptive right of six hundred and forty acres. Mr. Brough appeared in support of the application. and Mr. Wilson for the Mr. Brouh objected to the objectors. He %(*itcnd ed they had no locus standi, as the objection entered was not one of those recognised by the Act. Mr. Wilson considered tha objection perfectly sufficient, and that bona fide settlement was a public purpose. The Warden stated that he could not go on with the matter, as the application had not been advertised, and adjourned it for a fortnight, allowing £2 2s. Costa to Mr. Wilson. Oliver and Knowles v. Slaven and party. —This was an action brought to r> cover £34 Os., less one-fourth, being the profits of a race from the Eamseleugh Diver, duo to plaintiffs as partners, and also that the partnership might be dissolved. Mr Wilson for plaintiffs and Mr. Brough for defendants. Plaintiff a gave evidence to the effect that they had a fifth share of the race in question, and that they never could doAe to any arrangement with defendants. Mr. Wilson called James Slaven, one of the defendants, who declined to give evidence unless his expo ses were paid. Mr. Wilson asked the Warden to compel Slaven to give evidence, but be declined to do so. Mr. Brough contended that the plaintiff s had failed to prove their case, and the complaint could* not stand in its present shape. Mr. Wilson said his clients were partners in the race, but not partners in working, and that the Warden’s Court, being a Court of Equity, he could sue in in the manner he had done. The Warden said it was impossible to go on with the case, and adjourned it for a w ek for the plaint to he amended : costs to be considered when the case was disposed of. He recommended the parties to settle the matter by arbitration. M'Leod v. Brown.—Application to cancel water license for a race deriving its supply from springs on the commonage. Defendant did not appear, and the application was granted.
