RESIDENT MAGISTRATE'S COURT, CLYDE. Tuesday, February 14, 1871.

(Before James Hazlett, Esq., J.P., and William Fraser, Esq., J.P.) John Russell was brought up on remand charged with obtaining money under false pretences. The deposition of George Clarlt, manager for Allen Fitch, taken the previous sitting of the Court was read. It was to the effect that accused had obtained from him a suit of clothes, promising to pay for them in a few days. Not fulfilling his promise witness took out a summons, and accused not appearing witness obtained judgment and took nut a fraud summons. Appearing on that summons accused stated that he was duo £llO by the Provincial Government. He then gave witness an order on the Treasury, on the faith of which he advanced him £l. The order had been presented at the treasury when it was state that accused had previously given an order for the wholo of the amount due him. David Ross, architect, Dunedin, deposed that he had known defendant for about -hrec months. Adva- ced him £25 for the purchase of instruments to carry out a contract ho (accused) bad obtained from the Provincial Government, and afterwards £ls. Accused gave him an order on the Treasury for £!!■', the amount of the contract, also for £ll, the amount of the deposit thereon, on the 20th of October. In cross-examina-tion witness stated that he knw the whole of the contract had not been completed and that ho believed ho (witness) was entitled to the whole amount of the order, unless the expenses were lighter than he thought. Sergeant Smith deposed tnat he arrested the accused on the Bth instant, in one of the hotels. Told him that Mr. Clark had presented his order at the Treasury, and ho found that he (accused) had given Mr. Koss an order for the whole amount. He stated that he never gave Ross an order, and that he only owed him a few pounds. Witness was on duty at the Resident Magistrate's Court on the 21th of January last, and heard accused then swear, before Mr. Pyke, that there was no lien on the money due to him by the Provincial Government for his surveying contract. Accused then obtained a printed form of order on the Treasury, filled it up, and signed r. The Bench considered that a prima facie case had been established, and com mitten the prisoner for trial. M'Connochie v. Scott Claim upon an 1O U, for goo s sold and delivered. Defendant did net appeer, and judgment was given tor plaintiff for amount claimed and coats. The Court then adjourn©-’.
