POLICE AND WARDEN’S COURTS.

(Before H. W. Robinson, Esq.) ALEXANDRA. Monday, July 27 th. Theyers v Taylor, adjourned from last Court day, further adjourned for a week. Cosgrove v Galvin.—Claim for £2O damages for assault by defendant’s wife on the wife of Plaintiff. Mr. W. L. Bailey for Plaintiff ; Mr. J. C Chappie for defendant. The case was dismissed ; the evidence tending to show that Plaintiff’s wife was the aggressor. Police v a Chinese Restaurant keeper ;for a breach of the Municipal Bye Laws : fined 20 shillings and costs, and cautioned. Warden’s Court. D. M'Ewen v Hawley and anr.—Claim for £5 for encroachment. Dismissed with Costs and twenty shillings, expenses. Another case arising out of the same circumstance was withdrawn. CLYDE. Spensley v Badger.—Debt case. No appearence.—Struck out. CROMWELL. July 22, 18G8. Charles Grindley was charged with lunacy Remanded to Clyde for medical examination. WARDEN’S COURT. Nybergand party v Brown and others.— Mr. Badger for Plaintiffs. The complaint was that the defendants had ceased to rise a race hold by them under license, the complainants praying for a cancellation. The defendants did not deny the abannonment of race, but contended their right to the water was not lost. The Court ruled there had been no abandonment within the meaning of the Act, but under Sec. 115 of the “Gold Fields Act ” consented to constitute a money pe* salty instead of forfeiture. Fined £lO and 11 shillings, Costs. £S of the penalty was ordered to be paid to plain tiffs for expenses of suit.
