Monday, July 15. Before His Honor Judge Grey And a Jury of four, consistng of Messrs. Robert Barlow, Edmund Campbell, William Auckland, and William Atkins. Marsh v. Marsh. Disputed partnership account. Mr- W. L. Bailey for plaintiff; Mr. Badger for defendant. Plaintiff and defendant are brothers, and owned an hotel and farm at Cromwell. They dissolved partnership on the 21st of Deoembcr last. John Marsh, the plaintiff, was to receive all debts and pay all liabilities ; any deficiency to be made up jointly. It appeared that, as 1:0 balance-sheet had been prepared previous to the dissolution, the case was not within the jurisdiction of the Court. It should have been brought before a Court of Equity. Nonsuited.
RESIDINT MAGISTRATE'S COURT. EXTENDED JURISDICTION. (Before the same.) Crawford v. Coates.—Claim for £2l ICs., work and labor done. Judgment for amount claimed and costs, execution to be stayed for four weeks. Shaxlev v. Kelly.—Struck out. Dixon v. Page.—Claim for £IOO, goods supplied. Judgment for plaintiff, with costs : distresswarrant to issue ; in default, three months imj risonment. STAFFORD and another v. T!ae.—-Claim for £B3 155., goods supplied. Verdict for plaintiffs, with costs ; distress warrant ; in default, three months' Imprisonment. Same v. Same.—Claim for £75, amount of a dishonored Cheque. Verdict for amount claimed, and costs ; distress warrant; no effects one months imprisonment. Same v. Same.—Claim for £4S 13s Oil; rent of premises. Verdict for amount claimed ; distress warrant to issue : in default, two months imprisonment. Shaw v. Thomson. Claim for £35 Is Del; goods supplied. Judgment for plaintiff; distress warrant to issue ; in default two months imprisonment. Rivers v. Cameron-.—Claim for £36 Is Cd ; goods supplied. Judgment for amount claimed and Costs. Same v, Chapple, as Manager of the "Kose Thistle, and Shamrock Mining Comp.—Judgment for amount claimed and Costs ; execution to issue. Same v. Crust.—Claim for £SB 5s (id ; goods supplied; withdrawn. W. J. Barky v. John Marsh.—Claim for £S(J 13s. 4., illegal detention of property. Nonsuited.
