TO THE EDITOR OF THE DUXSTAN TIMES. Sir, —In the Warden's Court at Clyde, •on the sth inst, Edmund Jones was charged' by M'Kelvy and party, of Sandy Hook, with having unlawfully, on the previous Friday, made a breach in a dam erected by them on the Fraser river. Two men belonging to the All England Eleven Company accidentally witnessed the lawless act, and very properly <jave information to the parties affected thereby. The evidence produced by these eye-witnesses was perfectly conclusive as to" the culpability of the defendant, and Mr. Warden Tiobinson marked his disapproval of Jones's unlawful act by fining him in the heavy (?) sum of one shilling and costs. The verdict is deserving of no better character there pusillanimous of even the most indulgent mind. i It was proved by evidence in Court that numberless times a breach in the dam had been made in a most unaccountable manner, and despite the exercise of much vigilance no delinquent had been caught up to the present time. However, the most favorable view of the case, and say that this was the first and only time an unlawful breach had been made" in the dam by Mr. Jones or his subordinates, the fine was utterly non-commensurate tf theyoffence.
