Auckland, This day. There are fourteen prisoners awaiting trial at the Supreme Court criminal sessions, which open next week. The District Court was occupied on Monday with'a friendly suit in which Barlow, a stalwart half - caste, who captured the Maori murderer Wiuiata, sued the executor of the late Charles Smith for £120. Some peculiar facts were revealed in evidence. Barlow's mother was living at Mangaro prior.to her death, as the wife of Smith. When he received his reward from the Government Barlow gavo £250 of it to his mother, and it was invested in the Onehuuga Building Society. It. appeared, however, that Smith drew part of the money, and that he had power to draw money from time to time belonging to his reputed wife, Mrs Barlow. There was still £120 of the fund remaining, and the action was to recover this money. Both Smith and Mrs Barlow are deceased,- and no provision was made for this fund. The claim of plaintiff was in effect that the estate of the late Charles Smith was indebted to the estate of his reputed wife, but as the defendants are trustees they can't say whether the estate of Barlow's mother can rightfully claim this money. Tho male testator made certain provisions to take effect " after the death of my wife," so that it became a question whether he might not have a lawful wife living. New Plymouth, This day. Mr H. M.
