A DESPICABLE FRAUD.
Auckland, This day.
The Resident Magistrate's Court yesterday was occupied with rather a painful case, the position and former high reputation of one of the parties being considered. The case was Taylor v. M'Cormick, claim £13 15s for money paid to Mr M'Cormick, solicitor, for the purpose of being paid into Court in a previous case in wliich Taylor was the defendant. The conduct of M'Cormick was described by _Mr Taylor, who appeared for the plaintiff, as '' a mean, despicable, and disgraceful attempt to swindle, and a gxoss fraud." Thcallcga-r tion was that M'Cormick had applied to his own use the money, and instead of having the case heard he kept piling up affidavits to have it adjourned, it was alleged, in order to enable him to keep the man's money in his pocket. The plaintiff was examined, and deposed to the facts stated in his counsel's address. The plaintiff said he paid an additional £1 to Mr M'Cormick after giving him the £1-5 os. Judgment was given for plaintiff.
