IMPORTANT CIVIL ACTION.

Timartt, This day

In the Supremo Court yesterday, before Judge Johnston, tho civil case of the trustee in bankruptcy for C. W. Creamer v. D. McLeod, claim £360 10s damages, was heard. This was a peculiar action, arising out of an insolvency case. Creamer, when an insolvent debtor, arranged with the defendant to advance enough on a bill of sale to pay 10s in the £1. A cheque for £360 was handed over to one Jamieson, the cheque to bo transmitted to the trustees of the debtor. Jamieson lodged the cheque in the bank to his own account, sending his own cheque to the trustees. On being presented Jamieson's cheque was dishonored. .•Since then Jamieson had left the colony. The present action was brought to discover for whom Jamieson was acting, Creamer alleging that he acted for the defendant, and the defendant maintaining that he was acting for Creamer. The case closed last night, when a verdict was given for the defendant. The question of costs was deferred for consideration.
