BOROUGH OF NAPIER. rpilE following Bye-law having been X approved of by His Excellency the Governor is published for general information in terms of " The Municipal Corporations Act, 1870." M. N. Bye-hue of the Council of the Borruyh of I\ r aj)ier, made wider spread order of the said Council, dated tlie Sth day of November, 1882, confirmed on the 6th day of December, 1882, and sealed with the common seal of the Council on the HtJi day of December, 1882. To come into force on the Ist day of .Tannery, 1883. IN PURSUANCE of Section 319 of "The Municipal Corporations Act, 1576," the Mayor, Councillors, and Burgesses of the Borouirh of Napier ordain as follows :—- Clause 5 of Part V. of the Schedule to Bye-law No. 1 is hereby repealed, and the following provision is substituted therefor. 1. Every person who wilfully sets tire to any inflammable material whatsoever in the open air, or who wilfully lights a iire for any purpose whatsoever in the open air unless within a properly constructed fireplace, or without the written permission of the Council so to do, shall be guilty of an offence. Clause 2 of Bye-law No. 2 is hereby repealed and the following provisions arc substituted therefor. 2. The Council may by a resolution passed at any General or Extraordinary meeting cause a noticein writing to be served U]:>ontho owner or occupier of any premises, either by posting the same to him or by personal service, or by affixing such notice to some conspicuous part of the said premises calling upon him to remove, destroy, and abolish any cesspit or cesspool which may exist on such premises within one month from the date of service of the Notice, and in default thereof the Council may destroy, remove, and abolish such cesspit or cesspool, and the expense thereby incurred shall be recoverable by the Council from such owner or occupier. 3. The Council may by a resolution passed at any General or Extraordinary meeting cause a notice in writing to be served upon the owner or occupier of any promises either by posting the same to him or by personal service or by affixing such notice to some conspicuous part of the said premises calling upon him to alter within one month, from the date of the service of the notice any privy or privies on the said premises into an earth closet with the pan system to the satisfaction of the Inspector of Nuisances of the Borough for the time being, or other authorised person, and in default thereof the Council may alter such privy or privies, and the expense thereby incurred shall be recoverable by the Council from such owner or occupier. 4. No driver of any vehicle or no person riding on horseback shall drive or ride at any other than walking- pace round or across any comer, angle, or intersection of any of the streets or public thoroughfares. 5. Any portion of any tree or shrub overhanging any part of any public way or place within the Borough shall be removed on notice given so to do by the Council or its authorised officer, and any person neglecting to remove such overhanging portion of such tree or shrub after such notice shall have been served shall be deemed guilty of an offence. G. Any person guilty of any of the above offences, omissions, or neglects, or any person who shall obstruct any officer or other person employed by the Council in the performance of anything which such officer or other person is or may be required or authorised to do by or under any of the clauses of this Bye-law, shall be liable for every such offence to a penalty not exceeding £5. IN PURSUANCE of Sub-section 2 of Section 23-i of "The Municipal Corporations Act, 1876," the Mayor, Councillors, and Burgesses of Napier ordain as follows : — 7. Lime kilns and brick kilns shall be considered as buildings in which any trade or manufictory is carried on within the meaning of sub-section 2 of section 234 of " The Municipal Corporations Act, 1876." IN PURSUANCE of Section 23G and Division (s) of Sub-section 4 of Section 349 of " The Municipal Corporations Act, IS7G," and Sections 14 and 18 of "The Municipal Corporations Acts Amendment Act, 1880," the Mayor, Councillors, and Burgesses of the Borough of Napier ordain as follows :— 8. Upon the report of the Inspector of Nuisances it shall be lawful for the Council of the Borough of Napier to serve a notice in [conformity with the provisions of the above-mentioned sections upon the owner or occupier of land in or upon which a quarry now is or is about to be worked, calling upon such owner or occupier within one month from the service of such notice to build a brick or stone wall, of such dimensions as the Council may direct, in a proper and workmanlike manner, to the satisfaction of the Borough Engineer or other authorised person, along the line of street, road, or thoroughfare upon which such land abuts, or along such part thereof as may be indicated in the notice. In default thereof the owner or occupier of such land upon whom a notice lias been served as aforesaid shall be guilty of an offence and liable to a penalty not exceeding £5 for every week or portion of a week during which such wall remains unbuilt and unfinished. IN PURSUANCE of Section 340 of " The Municipal Corporations Act, 1870." the Mayor, Councillors, and Burgesses of the Borough of Napier ordain as follows:— 9. That Part 2 of Clause 10 of Bye-law No. 19, "Building- Regulations," be altered so as to read as follows : — Within X». 2 District. —Subject to the decision of the Council, the external wall of any building, if situated within 20 feet of any adjoining premises, must bo of some incombustible material approved of by the Municipal Engineer.
