A claim came before the Compensation Court under the Public Works Act yesterday, in which a claimant named Henderson seeks to recover £1062, the value of lands taken and injuriously affected by the Catlins River railway. The defence set up for the Crown was that against this compensation could be Bet off under the Act the amount of the increased value given to the land by the railway running through it, which the Crown asserted to be £2 peracre. Judge Williams said he could not decide the point at once, but at first sight it seemed to be a piece of startling legislation if the Act did provide as stated, for neighboring owners thus received a benefit unchallenged, which was denied to the owner through whose laDd the line happened to pass.
