BOROUGH COUNCIL.
MONDAY, SEPTEMBER 26.
The Council met at 8 p.m. Present: His Worship the Mayor (in the chair), Councillors M'Dougall, de Lisle, M'Kay, Wall, Swan, Monteith, Ellis, Cotton, and Graham. ELECTION FOE THE NORTH WARD. A certificate of the finding of the Resident Magistrate on the inquiry into the recent election in the North Ward, to the effect that the election of Mr Kenouf was void, and Mr Graham duly elected, was read. A communication from the Returning Officer stating the results of the recent Municipal election was also read. Mr Graham, after reading and signing the usual declaration, took his seat in the Council. CORRESPONDENCE. From the Surveyor-General, to
the effect that the Goternment were ■Willing to assist in making a definite survey of the streets in Napier on condition that the survey should be entirely under the control of the Chief Surveyor of Hawke's Bay. The estimated cost was £500, and the / Government would contribute one half on the condition mentioned. Resolved that the offer be accepted. \ From Mr Corry, in reference to fenc--5 ing in his property in the Shakespeare load. Resolved that the fencing in Shakespeare road be allowed to stand over until the re-survey of the town was completed. From Mr James Taylor, stating that Mr A. Ramsden continued to create a nuisance by burning lime and firewood. Kesolved that the Fire Inspector be requested to report on the matter. From Mr J. T. Renouf, resigning his office as h. member of the Council. From the Fire Inspector, asking that his duties might be defined by the Council. Resolved to refer the matter to the Council's solicitor.
From the Fire Inspector, enclosing a letter from the Superintendent of the Napier Brigade, stating that owing to the reduction of the Council's subsidy they could not purchase the necessary hose for the manual engine, and that a number of buildings would thus be left unprotected iv case of fire. The Superintendent also expressed a fear that the reduction in the subsidy might lead to the disbanding of the brigade. From Messrs Tait and Mills, asking that Mr McVay be accepted as surety in place of Mr Renouf. Agreed to. From Mr Monteith in reference to the formation of the Recreation Ground Company, and asking the Council to •withhold the Town Hall reserve from lease until a tender be submitted from the company. From the same, offering, on behalf of the company, to lease the ground for 21 years on the following terms:—For the first year £5 (a nominal rental, as it was proposed to expend £500 or £600 in improvements during the year); for the next five years, £60 per annum ; for the second five years, £90 per annum ; for the third five years, £120 per annum ; for the fourth term of five years, £150 per annum. A motion to rescind a previous resolution of the Council to lease the reserve in eections fell through, and the consideration of the company's offer to lease the reserve in one block was postponed. PUBLIC WORKS COMMITTEE'S REPORT._ The following report from the Public Works Committee was read :— Tour committee having met pursuant to notice beg to recommend the Council to give effect to the following : — 1. That various complaints Laving been made as to the non-fulfilment of the nightsoil contract the contractors be notified that the contract is determined as from the 15th instant, and that the sureties be instructed to carry on the same from that date. 2. That the engineer's report of the 19fch instant forwarded herewith be adopted. 3. That the tender of Messra Glendinning and Griffin for works on No. 7 drainage contract be accepted. 4. The committee bog to submit herewith the reports of the engineer and of Mr Stewart, C.T5., on the waterworks extension scheme. 5. That a notice be inserted in the newspapers warning persons from plucking flowers or taking dogs into the Botanical Gardens on pain o£ legal proceedings. Geo. Hγ. S-WAK, Chairman. In connection with the second clause the following report from the engineer was read: — 1. Trapped Grates. —Mr Garry has signed his contract for the supply of these, and is now proceeding with them. 2. No. 1 Drainage Contracts. —Tenders for these worke have been invited and will be laid before you. 8. No. 6 Drainage contract. Paradise-road Contract, Tree Guards Con tract. —These contracts are proceeding in a satisfactory manner. 4. Hasting-street. —The works required in connection with the conveyanoe of the storm water from the road is now completed, and the road generally is now in a satisfactory state. 5. Messrs Large and Townley's Application, Main-street Foundation, Spencer-road Metalling,—Owing to pressure of work in connection with the scheme for the extension of water to the hills, and with No. 7 drainage contract, I am unable to submit a report on these heads. 6. Extension of Water Supply.—l have the honor to lay before you the report of your consulting engineer, Mr James Stewart, C.E. , of Auckland, and my report thereon. Eobt. Lamb, Municipal Engineei*. Resolved that the reports respecting the extension of the water supply be referred to the Public Works Committee. All the other clauses in the report of the Public Works Committee were adopted. FRESIDETST GA.RFIELD. Cr. de Lisle moved that an address be forwarded to Mrs Garfield expressing sympathy and condolence with her on the death of her husband. Cγ. McDougall seconded the motion, Which was supported by Cr. McKay, and carried unanimously. Cr. Swan then moved that His Worship the Mayor and Councillors de Lisle and the mover be a committee to draw up an address to Mrs Garfield. The motion was carried. SWAMP SECTIONS AT THE SPIT. Cr. Cotton called attention to the condition of the Harbor Board's swamp sections at Port Aburiri, and asked if the Board could not be compelled to abate the nuisance caused by them. The Mayor said that nothing could be done nnless the Corporation cared to fill in the sections, and apply to the Board for payment. He considered the Harbor Board the ruin of the town. CARLYLE STREET. Cr McDougall called attention to the fact that Carlyle street was not wholly closed. The Council then adjourned.
