Between the Union Steam Sh'p Company of New Zealand (Limited), plaintiffs, and John Gibson Kinross, Joseph Liddle, Harmood Arthur Banner, John Wiinhouse Neal, John Close, and others, defendants. WHEREAS in an action for limitation of liability instituted in the Supreme Court of New Zealand on behalf of the Union Steam Ship Company of New Zealand (Limited), the owners of the steam launch " Boojum " against the above named defendant John Gibson Kinross, the owner of the steam launch "Sir Donald," and the other defendants above named, the owners of cargo laden on board the said steam launch " Sir Donald," the Supreme Court of New Zealand did on the sixteenth day of August. 1881, amongst other things order that the plaintiff Company should pay into Court a sum equal to £8 per ton of the cross tonnage of the said steam launch " Boojum," without any deduction for engine-room, addiner interest on the whole sum at the rate of eight per cent per annum from the seventh day of May la^t. And further that the defendants and eachof them and all other persons having claims against the plaintiff Comoany for damages or loss to ship, goods, merchandise, or other things occasioned by the collision between the paid steam launches "Boojum" and " cir Donald "be restrained from commencing or prosecuting any suit or action against tbe plaintiff Company in respect of suoli loss or damage. And further that the defendants and each of them and other persons having any such claims should be at liberty to appear and plead to this action as they should be advised. And further that the nineteenth day of Septomber be fixed as the day on or before which the defendants and all persons claiming to be ontitled to share in the distribution of the sum whereto the liability of the plaintiff Company is limited shall come in and state their claims or bo wholly excluded from such distribution. This is therefore to give notice to all persons having any claim in respect of loss or damage to ship, merchandise, goods, or other things occasioned by the said collision, that if they do not come in and enter their claims at the Supreme Court Houso at Wellington on or before the said nineteenth day of September, ISBI, they will bo excluded from sharing in the aforesaid amount.
