Thursday, Febbuary 10,1881

(Before Judge Kenny.) MITCHELL V. MERIUTT. Mr Lee for plaintiff, and Mr Lascelles for defendant. Claim for £72 11s 7d. Judgment confessed and entered for plaintiff, with costs and counsel's fee. NEWTON AND JOHNSON V. AXTJP. Mr Carlile appeared for plaintiffs!. This was a judgment summons on a judgment of the Supreme Court for £146 03 4d. Mr Carlile said that £48 2a had been paid since the judgment, and asked that an order be made for the payment of the balance, £97 18s 4d. Order made that the amount be paid by the 10th of March, or the defendant be imprisoned in Wanganui gaol for one month. ROLFE V. ARAWIRA TE OBIHAU. Mr Lee appeared for plaintiff, and Mr Lascelles for defendant. Claim for labor done in cutting greenstone. Mr Lascelles said that there was an irregularity ia the summons. The statement of particulars was not stamped with the stamp of the Court, as required by rule 12 of the District Court rules. He also took objection to the form of particulars. There were no items given, and it was not shown if the work was done under an agreement for a lump sum. Mr Lee said the work was done under an agreement for a lump sum, and the agreement was in existence. His Honor adjourned the case for fourteen days on the understanding that the bill of particulars should be stamped. This terminated the business of the Court.
