THEFT CHARGE FAILS
A verdict of not gulltv was returned by the jury in the Supreme Court, Wellington, at the conclusion of the trial of Archibald John Bryaut, seaman and labourer, aged 40, on a charge ot breaking aud entering the shop ot D. .1. Crotliers, Ltd., nt the corner of Kent Terrace and Majoribanks Street, and committing theft. He was acquitted also of the alternative charge of receiving 13 rolls of suiting and overcoating materials and a piece of pocketing material, of a total value of £125, knowing them to have been dishonestly obtained. The evidence for the Crown Included that of a man who, while passing ' the shop about 9.20 p.m. on February 10, noticed a ear parked nearby and became suspicious of the actions of some men. lie took the number of the car and saw rolls of cloth being put in it. When tlie car was gone he found the door of! the tailors’ establishment opeu and rang up the police. Evidence was given by d®toctlves that the ear was found in a Wellington street later in the night, and while they were watching it accused and another man came to it. Accused had a key to club premises in Cuba Street, and there the stolen goods were found. Mr. R. 11. Boys, who appeared for accused, submitted that the evidence produced by the Crown had not proved that it was Bryant who had stolen the goods or received them. ... The jury was in retirement Irom shortly ■before luncheon at. 1 p.m. till 2.18 p.m. Accused was discharged. Mr. Justice Blair was on the bench. The Crown Prosecutor, Mr. W. 11. Cunningham. conducted Hie prosecution.
