PROSECUTION FAILS
By Telegraph.—Press Association Christchurch, January 28. Holding that defendant had not been io charge of the car, though he was the owner, Mr. E. D. Mosley, S.M.. to-day dismissed a charge brought), against Charles Arthur Orr, aged 42. a bus proprietor of Oamaru, that ho had been intoxicated while in charge of the vehicle. ' The evidence showed that defendant and three companions came to the city from the .south, and that all took turns in driving, but that a man named Douglas Lawrence drove into Christchurch. Defendant was sitting iu the front seat, but on the left-hand side when the car was seen in Manehester Street. According to the police he was intoxicated.
The magistrate said that he was satisfied that defendant was intoxicated, but that he was not. in charge of a mechanical portion of the car.
