WHO IS LIABLE FOE ACCIDENTS? Dominion Special. Auckland, December L If a boy gets hurt at school while he is having a game of football, the education authorities are not liable, but the ease is not so clear if a child falls off a swing. The Fairfield School Committee at Hamilton wrote to the Auckland Education Board to-day protesting against the board’s action in requiring it to accept liability for accidents thj occurred through the use of swings. Mr. A. Burns (chairman) said that the , Education Board had always taken up. the attitude that a swing was dangerous, and the Teachers’ Institute considered that the control of swings was outside ’ the jurisdiction of teachers Clearly.' the board will be * responsible for any injury that resulted if teachers were required to exercise supervision. . Mr. E C. Purdio (secretary) stated that an action for damages had been brought some time ago in the Law Courts at Wanganui, and it was held that the Wanganui Education Board was not liable for an injury that occurred to a child through falling from a swing, as the swing had a defect. The matter of liability was referred to the board’s solicitors for a report.
