RETRIAL ORDERED
IN CIVIL ACTION. In the Supreme Court yesterday, His Honour Mr. Justice Hosking delivered judgment in a case in which Frederick William Varo had asked for a new trial of a civil action against George Edwin Tantrum and William Tantrum. The original action had been brought to recover damages for what may be shortly described ns the alleged wrongful obstruction by the defendants of the plaintiff’s right to the occupation and use of a certain farm. The defendants did not jointly defend the action. Georg© filed a statement of defence, and appeared ut the trial. William took no steps to defend and was not present or represented nt tho trial, and was said to have disappeared some six months before. As against him, th© object of the trial whs merely to assess the damages. George defended on tho ground that lip was under no liability. The trial occupied two days, and the jury, before giving its verdict, asked whether it was bound to give the amount of damages agreed on between counsel. The Judge replied in the affirmative, nnd thereupon the jury found for both defendants. His Honour yesterday granteel a new trial.
