POWER TO TAKE LAND

HARBOUR BOARDS SEEK EXTENSION. Already the Government, the city councils, and tho borough councils may acquire property under tho Public Works 'Act. Now the harbour boards seek such power, and the Lyttelton Board will submit the following remit to next week’s conference: — "That tho following section be submit? tod for section 163, Harbours Act, 1908, and section 140 ns amended by Harbours ‘Amendment Act, 1910:— "(1) Every harbour bomd may from time to time acquire by purchase, lease, or otherwise, or take under the provisions of the Public Works Act, 1908, (a) Any lands, buildings, or enjoin'ent, or any interest therein required for tho purpose of obtaining, access to, or a f'outage to a public road for any foreshore or.other land vested in it, or for or in connection with any undertaking V. hlch such board is. by. tho principal 'Act or. any special Act or any Order-in-Council made and granted under the provisions of the principal Act, authorised to enter into including onv under'taking mentioned in section 147 of the principal- Act, and including harbour works; (bl any earth, stone, boulders; gravel, sand, or other material off, from, or out of any land for <he purpose of Using tho same in or about any such undertaking, and whether such land be acquired or not. "(2) Nothing herein contained shall lie deemed to limit the powers of a board by virtue of the Public Works Act, 1908. "(3) This section is in substitution for auction 163 of tho principal Act, ana that part of tho Fourth Schedule to tho Harbours Amendment Act, 1910, which repeals section 140 of the principal Act and substitutes another section in lieu thereof and the said section 163 and the said part of the said Fourth Schedule are accordingly hereby repealed. "(4) (a) Where a harbour hoard deems it expedient to require more land than is required for tho above purpose, such harbour board may take, purchase, or otherwise acquire such land, (b) When the works have been completed the harbour hoard may sell or lease any surplus area.”
