CLAIM FOR POSSESSION
In tho Supreme Court yesterday, before His Honour Mr. Justice Sim, Leonard Carson Vaughan, of London, described as a gentleman, sued Andrew Martin Carrol, of Tennyson Street. Wellington, labourer, on tho ground' that on or about June 11. 1921, the defendant, without lawful excuse, entered on the property of the plaintiff who had ordered him to quit. The plaintiff claimed an older for possession, together with mesne profits at the rate of J? 3 a week from June 11. 1921, up to the date of the judgment. The defendant denied the allegations, and contended that on or about June 11, 1921, th'o plaintiff agreed to let the house to him at a rental of .67 10s. a mqnth, the first month’s rental to he paid before 11 <i.m. On Juno 12. He further alleged that he tendered the rent to plaintiff as required, but the plaintiff’ refused to accept the same.
Mr. T. C. A. Hislop appeared for the plaintiff and Mr. J. Scott for tho defendant.
After some evidence had been heard, tho Court adjourned until to-day.
