AUCKLAND CASES. By Telegraph—Press Association. Auckland, August 12. Tn tho Supremo Court to-day the third trial of Charles Joseph de Lucca, on charges of stealing end receiving etationery and fountain pens of a total value of' £lB9, the property of Collins Bros, and Co., was concluded. It was alleged that accused was supplied with the goods bv a fellow employee. Trevor Napier Peake, who had admitted stealing them and had been ‘••entenced. After a two hours’ retirement the jury returned a verdict of not guilty. His Honour: ‘ I suppose we may assume that you rend his confession." the remark referring to a signed statement made to tho police by de Lucca. Tho jury did not reply and the accused was discharged. ' Thomas Henry Loomb, a married man, 58 years of age, was charged with unlawful' carnal knowledge, or. alternatively, attempted carnal knowledge of nnd nttempted indecent assault on a 15-year-oJd girl on Mav 16. Tn evidence, tho girl, who is mentally deficient, said that she did not know the month of the offence. He- counsel paid that the defence was that tho alleged offence occurred in October, and as more than six months had elapsed no prosecution could be. Ac cused said that ho attempted to have oarnal knowledge of the girl about October. tills being the only occasion he did so. After an hour’s retirement the jury returned a. verdict of guilty, with a rider that the girl should be put under proper restraint. Couns“l moved to apply for n new trial on tho grounds that tho verdict was against the weight of evidence, and asked His Honour to fltnto a ease for tho Court of Appeal whether a. general verdict on three counts could stand. Tho Judge reserved his decision.
