REPAIRS TO MOTOR-CAR

PROFITLESS LITIGATION.

The Commercial Agency, Ltd., and Baker and Anyan,. garage proprietors. Lower Hutt (for whom Mr. .S. Moynagh appeared), took action in the Magistrate’s Court yesterday, before Mr. J. S. Evans S.M., to recover from Percy D’E. Hodgkins, land agent (represented by Mr. C. A. L. Treadwell, the sum of £lB 15s. 3d., balance of an account alleged to be due for motor-car repair, executed at the request of the defendant Hodgkins brought a separate action against Baker and Anyan to recover £l7O in connection with the repairs to the car. In his statement of claim. Hodgkins ®et out that in December, 1919 ho sent his car to Baker and. Anyan for repairs, and that in consequence of the alleged negligence , and incompetence of the firm, the repairs were not effected, and other damage was alleged to have been caused to the car. It was further claimed for Hodgkins that Baker and. Anyan undertook to effect the repairs by Christmas, 1919, but the car was not delivered until September 1920, when’ it was alleged to have been in a worse condition that when first placed in the firm’s hands. Hodgkins claimed thit owing to the alleged negligence, incompetency, and delay on the part of Baker and Anyan he had been obliged to hire taxi-cabs on many occasions, and. had expended about £5O in this way. He therefore claimed for this amount, also for £2O paid to Baker and Anyan on account, and £IW damages for loss of business. The hearing of the case took up the whole of the day. The Magistnjte gave judgment for Baker and Anyan for £9, and costs. In tlie case brought by Hodgkins the Magistrate held tbnt the damages were too remote, and that the action should tfwe been brought nine months ago. He gave judgment for Hodgkins for £9, and costs also.
