PLAINTIFFS NONSUITED. Janies Stacey and Andrew Duncan, labourers. (Mr. M. F. Lucie) proceeded against the Wellington Gas Company, Ltd. (Mr. T. Neave), to recover £l4, which they contended was due to them in connection with a contract for resetting and completing certain retort beds at Miramar, and being the value of the work done in the removal of old material from certain retort beds, which work, It was stated, should have bee.n Sono by the Company. For the defence it was claimed that the removal of tin old material was part of the contract, and therefore tho Company was not liable for Tiie amount claimed. After heaing the evidence, the Magistrate nonsuited ffie plaintiffs, but no costs were allowed.
