WHITWORTH WILL CASE
ACTION DISMISSED. London, April 6. The action against the late. Sir Joseph Whitworth’s executors has been dismissed with costs. Mr. Justice Evo said the odious and disgraceful conduct charged against the defendants was entirely disproved. The attitude of the plaintiffs in persisting in the charges was an outrage. There was no evidence of the testator’s mental incapacity. Mrs. Uniacke’s interests were properly looked after.— Aus.-N.Z. Cable Assn. FA saiit was heard in the Chaneery Court, in London, in respect of the estate of the late Sir Joseph Whitworth, which is valued at .£1,500,000. The administrator of the estate of the late Mrs. Uniocke, who was heiress at law of the testator, sued to set aside the deed signed by her relinquishing her claims upon the estate in return for the payment by the ■ executors of L 25,000. Sir Joseph Whitworth died in 1887. It wns alleged that when he was suffering from senile decay he was persuaded by Lady Whitworth and two executors named Christie and Darbyshire to leave, everything to them, to the exclusion of Mrs. Uniacke. The documents in the case were of such bulk that they were brought to the Court on a lorry. Eight counsel were engaged. Mr. Uniacke, husband of the heiress, was 14 years away from Australia fighting the, will f’etore he died. Mrs. Uniacke died in 1898. The executors are also dead.]
