MAGISTRATE’S COURT
POLICE, CIVIL AND BY-LAW CASES K. Hunt, S.M., dealt with the police business in the Magistrate’s Court yesterday. William Alfred Daley was charged that on January 28 he forged, the name of Bertie E. Lewor to a Post Office Savings Bank withdrawal receipt for £2O, and caused the Post Office to act upon seme as if it were genuine. There were further charges of forging a withdrawal receipt for £l7 on February 1, and of breaking and entering on February 21 the dwelling of Bertie E. Lewer, 19 Alpha Street, with intent to commit a crime. On th'e application of Chief-Detective Ward ho was remanded to Wednesday, March 2. and bail was allowed in one surety of £2OO, CIVIL CASES . Mr. W. G. Riddell, S.M.. dealt with the Civil business, and gave judgment for plaintiff in the following undefended cases: N.Z. Automatic Bakeries, Ltd., v. R. Glover, £l6 17s. 6d., costs £2 155.; Hutcheson EnilineerIng Co., Ltd., v. L. Simmonds, £6 9s. 6d., costs £1 12s. 6d.; Ellen Murray v. W. J. Kitteridge, £3 45., costs 145.; Laery and Co., Ltd., v. W. Costs £3 Is. In a judgment summons case, Arthur Bull was ordered to pay Jemima M'Lean £8 7s. by March 8, or undergo seven, days’ imprisonment. TENEMENT CASES. The tenement cases were hoard by Mr. E. Page, S.M. Robert -M'Guirc was ordered to give up possession of a tenement to Frank J. Knibbe by March 23, and to gay £l4 rent, and £3 6s. costs. Harry Palmer is to give up possession of promises to J. J. Boyd, sen., by March 22. , FIXING THE RENTAL. B. Semeion (Mr. C. W. Tanner) asked the Court to fix the rental of a small dwelling in Gordon Street at such a rate as would give him 7 per cent, on the capital value. The tenant paid 17s. 6d. per week, which the landlord considered insufficient. The Magistrate (Mr. E. Page) fixed the value of the property at £5OO. He said that 7 per cent, upon that would amount to £35 per annum, and the outgoings would be flted at £lO 10s., making a total of £45 IDs. per annum. He refused to make an order to increase the rental. I CLAIM FOR FENCING. John J. Trainer, school teacher. Wellington (Mr. W. G. Mellish) claombd from Amelia Johnston, of 524 Upper Adelaide Road (Mr. D. It. Hoggard) half the cost of a dividing fence amounting to £7 IDs. After hearing the evidence, the Magistrate (Mr. W. G. Riddell) held that the fence was not entirely for the benefit of the plaintiff, but that it did benefit the plaintiff more than the defendant. Judgment was given for'plaintiff for £4 and costs £2 14s. 6d. BY-LAW CASES Mr. F. K. Hunt, S.M., dealt with breaches > of the by-laws. Richard Robinson was charged with having* driven a motor lorry over the intersection of Taranaki Street and Courtenay Place at an excessive speed. He explained that he had been forced to put on •peed in order to avoid a double collision with two tramcars coming in opposite directions. He was convicted and ordered to pay costs and expenses 335. John Garland pleaded guiltv to exceeding the speed-limit, and admitted that his car might have been travelling at 30 miles per hour. He was fined 20s. and c* sts. Leslie Cooper was fined 10s. and costs lor failing to stop his car when requested by e, constable on point duty; For cutting round a street corner in a motor-car, Leslie George Wenham was fined 10s. and costs. H. O. Bennett was convicted on two charges of leaving a car in Majoribank Street without lights and of having failed. to register his car. He explained thau did not know it was necessary register a transfer of a car already tered by the former owner. On each of the first two charges he was lined ss. and costs, and for failing to register his car he was convicted and ordered to pay the Andrew Collins, who had failed to stop his car in Manners Street when signalled bv a constable, was fined 10s. and .tests 7s. ‘Goon Hing, charged with negligently driving a motor-lorry in Courtenay 1 lace, was fined ss. and 7s. costs. Laurence Dixon and R. Lucas were encn fined 10s. for riding a motor-cycle on the Hutt cycle track. One. was riding pillion and admitted that he. was as much to blame as the driver, s’nee he persuaded him to ride on the track. Ernest Marian was fined 10s. and costs for cutting round a street corner in a motor-car. _ wut. For allowing stock to wander, William F. Fitzgerald, Samuel Jones, Noran Kyan, William H. Smith, and George Williams wore each fined ss. and 7s. costs; Albert Bowden. Ernest Hadley, L. M. Williams (two charges), and Stephen Stevens were each fined IDs. and costs; John M. kouiig was ordered to pay costs 75.. and lau Olsen, an old offender, was fined X 3 and costs.
