Mr.' W.' G. ltiddell. S.M.. delivered r*icrved judgment yesterday morning in the Magistrate's Court in the case of Fred. Fanning and Co. (Mr. W. Perry) against Henry Gant. proprietor of tho Elthani Hotel' (Mr. 11. F. von Haast), n claim .for £150. commission alleged to be due on the sale of the defendant's hotel. His Worship agreed with the contention of counsel for the defendant that the agreement for salo and purchase drawn up wns sufficiently definite to be binding between the parties, though it was true that tho defendant had refused to carry out tlio agreement to sell to a third party on another ground. The Magistrate nonsuited the .plaintiff.
