William Tobin and Samuel' Ward, appeared to stand their sccond trial on a charge of having stolen JE9, the property of Harry Hayr, at Avondale, on October 2. Alternative charges of theft and having fraudulently omitted to account for moneys received on tho totalisaipi at Avondalo were also preferred against accused. The first trial of accused was on November 23 and 24, beforo tho Clnel Justice, when the jury failed to agree. Evidence similar to that given at tlio firsil trial was tendered to-day. lne case for the Crown rested upon two transactions, in one of which a .£lO note, and 1 in the other a £a noto were handed in at the window of the totalisator, where t'hc two accused were employed, no change being received by tho persons who handed them in. . Both accused gave evidence denying any guiltv intention. Tobin stated that lie gave the .£lO noto to Ward to hold in case anyone came back and claimed it Waid silted that when Hayr spoko to him aliout the <ElO noto ho immediately produced it, and handed it to Hayr. When Tobnn gave liim the ,£lO note ho told witness to give it » the owner if bo cnlled for it, and to collcct ,£1 Evidence as to character was called. After a short retirement the jury returned a verdict of not guilty, and tho prisoners wero discharged.
