Ball, nttvocatft for tho appellants, in an application to the bonrd to rule that where the Uo pavtment sought to justify the promotion of a member to supersede nn appellant the service records of the member superseding should no produced as nvidence. The application was vigorously opposed bv Mr. .T. Mason for the Department. Mr. 801 l further applied for a' ruling that evidence as to. incidents occurring after the date of an adverse decision should be, inadmissible as evidence. After retirement the board upheld both contentions with tho reservation that respecting the reclassification of last year, which wasi only authorised by the amending Apt of Normnber last, evidence should be admitted up to the date of the amending Act.
