FINE OF ,£SO SUSTAINED. About a month ago, Patrick Cavanash, of ICaiwarawara, was fined .£SO by Mr. J. S. IJvans, S.M., in the Magistrate's Court, for selling milk from an unlicensed dairy. Mr. T. C. A. Hislop, who had been instructed to appear for the defendant, was unable to bo present, aiid Cavanagh was fined as stated. A rehearin'g was applied for and granted, and tho case came oil in tho Magistrate's Court yesterday, before Mr, li\ K. Hunt, S.M: ' " T. CI Webb; inspector of the De- • partuient of Agriculture, slated that about 12 months ago Cavanagh was granted a license, which wti's subsequently cancelled. later, a license was graute'd to a young 1 man named Hobbs, wlm was Ciwanagh's employee, on condition that ho took control of the dairy. • This license was oaneelled .on September 8, and on October 13 an. inspector of. tho' Department purchased a pint of milk from Hohlis for 3d., tho milk being delivered into tho billy provided by .the inspector. Two days _ later, another. inspector purchased milk from a cart, which bore the name of Cavanagh, and wus driven by Hobbs. The milk from the unlicensed dairy was still boihi? distributed, but it woe-stated that it. was being given away. \ A bonrdlnßhouse-keeper, and the. proprietor of a tea-room, were called to show that the milk was still being dietributed, to between 00 and 70 customers, free of cnarge. • Hobbs, who was' callod for the- prosocution, said lie was employed, by Cavanagh. and was liaid «£2 10s.- per week and "found." Cavanagh instructed, him to oOllect all moneys due up to September 8, in the meanwhile to give the milk away, pending a ronewal of the llcc-nse. ftobbs said that, when the inspectors obtained tho milk he was led to beliovo that tho purchases wore for testing puvposes. ' , . For the defence, Mr. Hlslop conteiidca that 110 ofieiice had beon committed, (mice the witnesses called for tho - prosecution had stated that the milk _was given to tliom free. Tho cows had to bo milked, and the milk had either to bo givfth atf.iv or thrown away, wid it was preferred to give it away.
