CONTRACT RESCINDED
CASE IN SUPKEME COURT. The civil litigation in which Isabella Cairns claimed rescission of contrnct for the sale and purchase of a house, on- the ground of misrepresentation, from W. H. Frost was concluded' in lie Supreme Court yesterday before His Honour Mr. Justice 'Salinond, the Judge upholding the claim, with costs on tho highest scale, and ordering moneys paid to be refunded.
Mr. O. C. Mazengarb appeared for tho claimant, and Mr. J. Scott for Nio defendant. The claim was based on allegations that the defendant had stated the house in question was free of borer, and was sound; and built of heart of Kauri, whereas, when plaintiff took possession, it was found that there wns borer in the house. Tho contrnct was for the sum of XS3O, on torms. For the plaintiff. Mr. Mazengarb submitted thai, only tho weather boards of the. residence were heart of kauri, and borer wore in tho hou6o, in addition to which the roof wns in a bad state, nJid was leaky. In defence. iOhrough Mr. Scott, Frost denied the righii of the plaintiff to any relief, and stated that she had had , since November, 1919, to ascertain the state of the premises. j
