A MOTION DISMISSED. By Association. Christehurch, November 18. Mr. Justice Herdman dismissed a motion for a new trial in the case Peter Dewar Boos, Christehurch, and Arthur Daniel Kennedy, Wellington. Charges of fraud were made by both sides in respect to thefsale of Mount Whitnow, Canterbury, from defendant to plaintiff, and the sale of the Paerata Estate, Auckland, from plaintiff to defendant The jury decided that defendant had been guilty of fraud, and that plaintiff had not, and it awarded plaintiff (Bong) JJ1535 10s. damages. Defendant applied for a new trial on the ground that the verdict was against the weight of evidence and tho damages excessive. His Honour said the jury had not been guilty of any unreasonableness' that would warrant Ms interference. •
