MOTION, FOR NONSUIT
APPEAL BEFORE CHIEF JUSTICE. The Chief Justice (Sir Robert Stout) in thf; Supreme Court yesterday dealt with a motion for nonsuit, and. alternately, for a new trial, in the case of E. W. Dale OVaikaremonna) and John Gillespie (Palmerston North). The appeal was made by Gillespie against a judgment of Mr. .Tuetico Hoskins;, awarding X 275 damages to Dnle for alleged slander on the part of the appellant. At yesterday's proceedings Mr. 11. R. Coop.er represented the appellant, whilo Mr. L. A. Rogers appeared for tho respondent. Tho original case had arisen over a letter written by the appellant- concernin? the loss of a.rug at Waikaremoana, where the respondent had charge of the* hostel. Tho appeal was brought on tho ground that the jury, in givinjr a verdict for tho plaintiff Dale, had failed to answer. in accordance with the weight of evidence, thjj third issue nut to tlffln, i.e.. whether tho letter referred to liad been actuated by malioc. After hearing, legal argument, tho Bench reserved decision.
