The lessee of an apartment house and a cottage close by wished to have an order of ejectment made against a. subtenant of' the cottage. At the end of a week the rental was reduced to 215., ond after R time the defendant reduced the rental by adopting the Simof paying just 20s. and no Lore. .Thus tho plaintiff received .£1 week and paid that sum away as rent while the defendant had the use of the fens stove in the cottage The. plaintiff sought to have the sub-tenant Stated in order that possession of the vacant' cottage might be given to the „ MM w lio were unwilling to take it SnC vacant. The had paid into Court the balance of the oS eible that the Court will .be asked to decide whether the tenant is entitled to a refund of 55., from the owners or tha agents of the owners, and whether tho first sub-tenant should have a refund 15s. per week. ■
