INTERESTING CASE DECIDED,

Finally was reached in , the Supremo Court yesterday-'in connection,with the application for the discharge from custody of Robert M. Rous, who was recently made the subject of an extradition order in the Magistrate s Court, following on the issue of a provisional warrant in Sydney charging him with having deserted his wife and child in Ne South Wales. Mr. A. B. Sievwright appeared for Ross, and Mr. J. Prendeville lor tho Crown. , Tho case was adjourned by Mi. Justice. Salmond on Wednesday to allow appellant to file a motion togetjher w-th affidavits for the discharge of the order of extradition made by the Magistrate. On the Court resuming yesterday i « Honour R'iated that he had read the affidavits in the case. Ho wasl safasnM that he could not interfere with the dec.ision of the Magistrate, and the motion would accordingly be dismissed His Honour observed tbn*i the Magistrate had not to be entisfietl about the guilt of the person before him. He only had to lU satisfied that- the warrant was isnipd bv a properly-authorised person. fl\e order of Iho, Magistrate would stand, and Ross would be delivered into the custody of the escort for extradition to New South Wales.
