Sin Turner, pOßlession of a tenement, costs 17s. A TENEMENT CASE. G. Albright (for whom Mr. J. Scott appeared) proceeded against Mrs. J. Killiher (represented by' Mr. J. O'Donovan) to recover £25 by way of damages, resulting from the manner in which l'e was dispossessed of a house he had occupied as a tenant, and rented from the defendant, lie had been notified by the defendant that she required tho house for her own occupation, while, as a matter of fact, she did not occupy the premises, which had been let to a third party. He claimed that he had been put to tmneceisary inconvenience; and had also lost money on the snJe.of his furniture. , The defendant stated that she had every intention of occupying the house, when' the notice was given, but she was obliged to aban-. don her intention because the house was damp, and was approached by steps, which were too much for her The Magistrate, in giving judgment, remarked that the tenant had departed from the usual practice in' vacating the itemises before the expiration of the period of his notice, whereas had he considered that the defendant had acted deceitfully in stating that she required the house for her own use, he would have stayed on. As the plaintiff had not shown that the defendant had _ acted deceitfully, the action'| would be dismissed. ARCHITECT'S FEES. Herbert Thomas Barnes, architect (for Whom Mr. W. Perry appeared)! proceeded ngainst James O'Connor, carrier, to recover £27 10s. for fees for professional services in connection with the preparation of plans and specifications for a dwelling at Island Bay, to be erected for the defendant. After hearing the evidence the Magistrate gave judgment lor plaintiff for £20, with costs £J 17b. BY-LATCASES Mr. J. S.
