Sir John Findlay, K.C., counsel for Defendant, J. J. Dryce, made the following statement in the Supreme Court, August 19,1920:"In this action the Plaintiff complains that the Defendant has published to Shareholders of the New Zealand Co-op-erative Distributing Co. and others statements reflecting on the Plaintiff's character, business conduct, and offioiency when acting os the General Manager of the above Company. lam instructed by the Defendant to state that he withdraws any imputation mado either on the personal character or general business competency or efficiency of Mr. Hunt, and expresses his regret for having mode the statements which are regarded as injurious to Mr. Hunt's reputation and character. The Defendant wishes to say that he never had it in his mind to impute misconduct to Mr. Hunt or inefficiency while acting l os Manager of the Company, but as he recognises that statements made by him might lend themselves 'to this interpretation he desires now to absolutely withdraw any imputation of the kind." "The Defendant will pay towards costs and expenses." Pkintiff thereupon agreed to withdraw the action. IN THE MATTER OF "THE COMPANIES ACT, 1908." Tho payments will bo made through' Brokers by cheque payable to "order."
