CLAIM AGAINST WELLINGTON LAND AGENT. -..-■ Br Telegraph—Press Association. Christchurch, August 23. The civil sittings of the Supremo Court opened .to-day. Th 6 first case;., set down for hearing was an action brought by Peter Dowar. Boag, farmer, of Christchurch, against Arthur Daniel Kennedy, land agent, Wellington. Plaintiff claimed J22098 19a. Id., made up as follows":— .£1535 16s. damages for alleged fi.lso and fraudulent statements made -by defendant, namely, that certain stock at Mount Whitnow (Okuku) 6old to plaintiff had been valued at iCSOO, whereas the valuation was £im is., ,£313 Ss. Id. difference between a certain sum said to be owing to tho New Zealand Farmers' Co-operative Association and the amount actually owing: and .£250 for defendants delay in carrying through the contract. Defendant lodged a counter-claim for ,£3500 damages and interest, alleging that plaintiff had stated that on a property to be taken in part payment for Mount Whitnow there were encumbrances amounting to 'i 5025, that his equity was of the value of ; <£5955, and that be had paid ,£47 per acre,for land. Such statements, defendant-al-leged, were false and fraudulent, in that in addition to the aggregate principal sum of .£5025, interest was greatly in rrrears, and the first mortgagees had nppleid for leavo to sell, and subsequently <iid- so for a sum less than the amount .of .the."first mortgage. The property, defendant claimed, was not of tho value alleged .by plaintiff, and was'not worth tho amount of the mortgages (£5025) thereon. Defendant also alleged that plaintiff had not, as he had stated, paid Ml an acre for the property, that by reason of alleged fraudulent representation defendant was' induced to part with the Mount Whitnow property to plaintiff for '.£5500. less than it was worth, and ho therefore claimed that amount with interest," ;The case is not concluded.
