RECENT LITIGATION REVIEWED A COMPROMISE ARRANGED The conviction of No. 1 Milk Distributing Company on a charge of having broken its con'.ract with the Wellington City Council by failing to supply with milk one Jniues Darling was the subjrot of an appeal heard by the Chief Justice yesterday. / Mr. E. Page, S.M., decided the case in the Lower Court. _ It was shown that Darling resided within tbo district or block allotted to the defondant company, and that his residence was situated on a public road which was only pnrtly formed. The place was approached either by a walk of some cighty-fiva yards along a public footway from Eawhiti Tcrraco, or by a walk of some thirty-five yards along a path from Upland Eoad. The nearest point to which a milk-cart could ]>o brought was the end of Kawhiti Terrace or tie end of Upland Eoad, and during some ten months' prior to tho hearing of the case, the defendant company bad been taking to cart to the end or Knwhiij Terrace. The company notified Darling that nrllk would l>e delivered only if a receptacle were placed at tbe end of Hawhiti Terrace; and as Darling did not placo \ receptaclo thero the company for several days did not supply him with milk. Tlio Magistrate convicted the defendant, and imposed a fine of ,£l, with costs. Mr. T. Neavc appeared yesterday for the appellant company, and the city solicitor (Mr. J. o'Shea) for the respondent. After tbo case bad been partially argued Mr. Neave mado an offer on behalf of ifho appellant company to agree to tbo appointment of Mr. H. A. Ward, general manager of the corporation milk depot, as arbitrator between tho company and the corporation in all cases in dispute, bis decision to Ik binding. Mr. O'Shea ngrced i to this course, and His- Honour accordingly dismissed tlia appeal, subject to an agreement bcinpf entered into in terms of Mr. Ncave'a offer.
