W. ■ Jiickson appeared) proceeded against Kichard Whyte to .recover possession of certain goods held by defendant after plaintiff had vacated a room rented from him, or, as an alternative, the value of tho Roods. The Magistrate said, nftc'r hear-, irig the evidence, that it was merely a question of credibility of the . two witnesses, and he preferred to .accept the statements made by ' tho plaintiff. Bo i ordered tho 1 goods to bo handed over : within'forty-eight hours; in the alternate that the value of the goods, =£6 45., together with £2 as damages, bo paid ro tlw plaintiff. The defendant was also ordered to pay costs. The City Carriage and Motor WorKs, ' Ltd., proceeded against Chapman and L.V Hogue, motor proprietors, to recover' tho sum of £82 13s. for njaterials aup.plied and work dono for tile defendants X 'in respect to repairs to a motor-car. Mr. A. W. Blair appeared for the plaintiffs. It was shown in evidence that i both defendants went with the car and ordered sundry repairß. The-, car was late," sold to a man named Williams, and after the repairs had been finished / it was taken away by Chapman's brother, ;' who was driving for Williams. ' The d<>- . fence was that proceedings were being ; - taken against the wronj parties, and that the proper person to bo sued was Williams, who had jiurchased thu car 'while repairs were being made. It,was ■ alleged that the plaintiffs know that Williams had purchased the car, and that' they were informed he would bo responsible for the cost -of tho repan*. Mr; W. N. Matthews appeared for defendants.
